These Terms and Conditions govern both (i) consumer purchases via the website and (ii) business-to-business (B2B) supply of Bamboo Plastic Composite (BPC) and other products by We Do Bambusa Ltd ("Company"). By placing an order or entering into a supply agreement, the customer ("Customer") agrees to be bound by these Terms.
1. General
These Terms apply to all sales of products by We Do Bambusa Ltd. These Terms comply with applicable Kenyan laws, including the Consumer Protection Act and the Data Protection Act.
Nothing in these Terms limits any statutory rights available to consumers under applicable law.
2. Products and Availability
We offer bamboo-based products including:

Bamboo poles

Bamboo seedlings
-
Bamboo Plastic Composite (BPC) products such as decking, cladding, and wall panels

Natural bamboo products (including poles and seedlings) are subject to natural variation in size, shape, colour, and durability. Such variations are inherent to the material and do not constitute defects. All products are subject to availability. Where products are made-to-order or limited in stock, this will be indicated.
3. Technical Information and Product Use
All technical data, specifications, and performance characteristics provided by the Company are indicative and based on current production configurations. Products are not fully certified unless explicitly stated. Performance may vary depending on installation, environmental conditions, and application. The Customer is solely responsible for verifying that the product is suitable for its intended use. The Company shall not be liable for application-specific performance unless explicitly agreed in writing
4. Pricing and VAT
All prices are listed in Kenyan Shillings (KES) and include VAT unless stated otherwise. Prices may change at any time without prior notice.
5. Orders and Payment
Orders must be paid in full via MPesa or electronic bank transfer (EFT) before delivery. For large commercial orders, partial payments may be accepted at the Company’s discretion. Orders are only confirmed upon receipt of payment.
6. Delivery and Risk
We deliver across Kenya, excluding Lamu, Turkana, and Garissa. Delivery is made through third-party logistics partners. Estimated delivery time is within 5 business days from payment confirmation. Risk in the goods passes to the Customer upon delivery. The Company is not liable for delays due to force majeure events, including but not limited to strikes, weather conditions, transport disruptions, or government actions..
7. Installation and Use
All products must be installed in accordance with Company guidelines. Failure to follow installation guidelines voids any warranty. The Company is not responsible for damage resulting from improper installation, misuse, or incorrect storage.
8. Returns and Refunds
Returns are only accepted in cases of verified manufacturing defects or transport damage. Claims must be submitted within 3 business days of delivery, supported by photographic evidence. If approved, the Company will cover return shipping costs and provide either a replacement or refund up to the original purchase value. This clause does not limit any statutory consumer rights under Kenyan law.
9. Warranty
The Company provides a project-based limited warranty for manufacturing defects. Warranty terms, duration, and scope are determined on a case-by-case basis depending on:

Project specifications
Any warranty is only valid if explicitly confirmed in writing by the Company. Unless otherwise agreed in writing, no standard warranty period applies. Warranty (where provided) covers structural integrity only and does not cover:

Normal wear and tear

Colour changes due to UV exposure

Surface patination
-
Natural variations in bamboo products
-
Damage due to improper installation, misuse, or incorrect storage
10. Building Compliance and Certification
Products are not certified for specific building code applications unless explicitly stated. The Customer, contractor, or project engineer is responsible for ensuring compliance with all applicable building regulations, safety standards, and approvals.
11. Limitation of Liability
The Company’s total liability is limited to the purchase price of the product. The Company shall not be liable for any indirect, consequential, or economic losses, including but not limited to:

Loss of profit

Project delays
-
Third-party claims
12. Privacy and Data Use
The Company collects personal data solely for order processing and delivery. Customer data may be shared with logistics partners where necessary. Customers have the right to access, correct, or request deletion of their personal data in accordance with the Data Protection Act.
13. Intellectual Property
All content, including images, branding, and product descriptions, is the intellectual property of the Company and may not be used without written permission.
14. B2B Supply Terms (Applicable to Commercial Orders)
14.1 Scope
These provisions apply to bulk, project-based, or commercial supply agreements.
14.2 Suitability and Design Responsibility
The Customer (including contractors, engineers, and developers) is responsible for:

Product selection

Design integration
-
Structural and safety compliance
-
The Company does not provide engineering or design liability unless explicitly agreed in writing.
14.3 Technical Variability
The Customer acknowledges that BPC products are subject to variation in:

Colour
-
Texture
-
Performance characteristics
Such variations do not constitute defects.
14.4 Installation Responsibility
Installation must be carried out by qualified professionals. The Company accepts no liability for installation errors or project outcomes.
14.5 Project Risk
The Company is not liable for:

Construction delays
-
Design failures
-
Regulatory non-compliance
-
Performance in specific project conditions
15. Force Majeure
The Company shall not be liable for failure or delay in performance due to events beyond its reasonable control.
16. Amendments
The Company reserves the right to update these Terms at any time. Updated Terms will be published on the website.
17. Governing Law
These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the jurisdiction of Kenyan courts.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
